Summary

With six new active judges on the Court since May 2017, the landscape of the Sixth Circuit is changing. Using a few recent cases as a case-study, including Taylor v. Saginaw, No. 17-2126 (6th Cir. 2019), Fowler v. Benson, No. 17-2504 (6th Cir. 2019), United States v. Christian, No. 17-1799 (6th Cir. 2019) (en banc), and the denial of en banc review in the Flint, Michigan Water Case (Guertin v. Michigan), this session will discuss ongoing trends in the Court and how it affects Tennessee practitioners.
