BPR Proposes Amendment to RPC 8.4 Concerning Discriminatory Conduct

Comments Due by April 1

The Board of Professional Responsibility has filed a petition with the Tennessee Supreme Court, asking the Court to amend RPC 8.4 to add a new paragraph (h), making it professional misconduct for a lawyer to engage, in a professional capacity, in certain discriminatory conduct. The proposed new subsection 8.4(h) states “[i]t is professional misconduct for a lawyer to:...(h) engage in conduct, in a professional capacity, manifesting bias or prejudice based on race, sex, religion, national origin, disability, age, sexual orientation, or socio-economic status. Legitimate advocacy respecting the foregoing factors does not violate this provision.” Written comments may be submitted to Mike Catalano, Clerk, Tennessee Appellate Courts, 100 Supreme Court Building, 401 7th Avenue North, Nashville, TN 37219-1407 by April 1, and should reference docket #M2013-00379-SC-RL1-RL. Support Law School Mediation Team's Trip to Nationals, April 3-4

Under the direction of attorney Steve Shields, the University of Memphis School of Law’s Mediation Team, comprised of students Tom Williams and Chris Martin, has won the regional competition for the second year in a row. Facing the University of Tennessee team in the championship round, it is reported that the U of M was “flawless.” They now go to the National Competition in Chicago on April 3 and 4.
Sheree Hoffman and David Wade of the MBA’s ADR Section are co-chairing the fundraising activities for the University of Memphis team. Due to budget constraints, the law school is not in a position to help with expenses (estimated at $5,000 for the Regionals and $4,000 for the National Competition) so the ADR Section has become the primary source for funding and support. You may send your donation to David Wade at 6410 Poplar Ave., Suite 1000, Memphis, TN 38119. Please make the check payable to the Memphis Bar Foundation and note that it is for the U of M Mediation Team. Every donation in any amount is important and appreciated and is tax deductible as a charitable contribution.
